With Intelligence Labor Settlement Restores 6 Illegally Removed Positions and Protects Guild Work Jurisdiction

NEW YORK, November 3, 2022 — On October 24 the Pageant Media Workers’ Guild (PMWG) and With Intelligence (formerly Pageant Media) entered into a settlement agreement with respect to PMWG’s charges that the company had illegally removed bargaining unit work from the unit of editorial and production employees represented by union. Under the terms of the settlement, the company agreed to restore substantially all the bargaining unit work covered by the charges, representing 60% of current bargaining unit positions. 

The parties settled one day before a scheduled hearing on the charges before the New York office of the National Labor Relations Board.

The company agreed to restore the following bargaining unit work:

  • the Fund Intelligence reporting positions transferred to the company’s Boston office around May 2021, June 2021, and July 2022
  • the U.S. Investor Team reporting positions transferred to the company’s offices in the UK around November 2020 and April 2021
  • the Global Wealth reporter position transferred to the company’s London office around May 2022

To fulfill this commitment, the company will bring the three Boston-based positions into the unit, fill the current U.S. Investor Senior Reporter vacancy in the United States by November 30 and fill two additional unit positions in the United States by December 31. 

Additionally, the company agreed to recognize PMWG as the sole and exclusive collective bargaining agent for editorial and production employees in both the New York and Boston offices, as well as any future offices in the U.S where employees share a sufficient community of interests under Board law. The company also agreed not to remove bargaining-unit work that would result in the elimination of any bargaining unit position. These contractual commitments will be incorporated into the overall collective bargaining agreement being negotiated but are immediately enforceable through grievance-arbitration.

Under the NLRB settlement, With Intelligence has agreed to bargain in good faith with the PMWG and not to change the terms and conditions of employment without providing PMWG notice and an opportunity to bargain to good faith impasse or agreement.

The settlement applied to NLRB cases 02‑CA‑275588, 02‑CA‑284726, 02‑CA‑297426, and 02‑CA‑303041.
